Important Change in Law for Auto Insurance

Prior to July 1, 2003, Colorado’s insurance system was a "no-fault" state. In short, that translated to property damage which was covered by the party "at-fault," while each driver’s personal/personnel injury was covered by his/her auto insurance policy (Personal Injury protection or PIP) regardless of whether he/she was found negligent. This was intended to provide immediate medical coverage for both parties, while limiting the amount of law suits that a driver could file or be subject to, thus keeping auto insurance premium costs down.

However, currently Colorado auto insurance is based on a "tort" system. This is a standard policy based on the premise that the "at-fault" party pays for all damages - personal and property.
